Facts

The administrators of the estate of the late Alhaji N.B. Soule brought an application to the Registrar of Titles in Lagos to be registered as owners of freehold property at No. 16, Williams Street, Lagos. The said property had the Muslim Bank in possession.

The Liquidators of the Muslim Bank (W.A.) Limited objected to the registration on the ground that the late Alhaji Soule had not only sold the property to the Muslim Bank but was also its managing director.

The objection was overruled by the registrar who thereupon ordered that the applicants should be registered as owners.

The High Court reversed the decision and sustained the objection. The Court set aside the order of the Registrar of Titles.

The applicants appealed to the Supreme Court.
